Assisting Employers
Failure to comply with the current laws and procedures can be extremely costly for employers and many businesses are not aware of the full extent of their duties towards their staff. Employers need to consider their obligations under employment law and contract law every single day. These will range from hiring people and making all employees aware of their rights and obligations, to maternity and paternity rights, being careful not to discriminate directly or indirectly, to ensure all grievances and disciplinary matters are dealt with appropriately and ensuring that any termination is dealt with in a fair manner both for the dismissal reason itself and the procedure.
Particular attention needs to be given to the purchase and sale of a business and the obligations on the purchaser under the Transfer of Undertakings (Protection of Employment) Regulations 2006. These will also be relevant where contract to provide services is being acquired in place of a previous provider with no direct relationship between the businesses. We can assist employers to prevent disputes arising and we can also assist in circumstances where difficulties have already arisen.
Assisting Employees
Through the media, advanced education and the wonders of the internet, employees are becoming increasingly aware of their rights. Tribunal claims are on the rise and it is important that employees are represented to ensure that they are not being treated unfairly and/or being discriminated against.
In many cases matters can be settled amicably between the employer and employee prior to instructing a solicitor and in such circumstances our role is limited to drafting and/or advising on a suitable Compromise Agreement.
Sometimes we may be required to assist with settlement of a dispute before it gets out of hand but in other cases it is necessary to take matters further and we can assist you with evaluating your case and representing you before the Employment Tribunal.
